OVERVIEW
Welcome to Baby Pack. The terms "Baby Pack," "we," "us," and "our" refer to Baby Pack. The terms "you," "your," and "Customer" refer to any person who visits, browses, or purchases from our store.
Baby Pack operates this online store and website, including all related information, content, features, tools, products, and services (collectively, the "Services"). The Services are powered by Shopify, which enables us to provide them to you.
These Terms of Service, together with our Refund and Return Policy, Shipping Policy, and Privacy Policy, which are incorporated herein by reference (collectively, the "Terms"), govern your access to and use of the Services and all purchases made through them. By visiting our store, using the Services, or placing an order, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
These Terms do not limit any rights you may have under applicable consumer protection laws or other non-waivable statutory rights.
1. ELIGIBILITY AND ACCOUNT
1.1 By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence and legally capable of entering into a binding agreement.
1.2 You agree to provide accurate, current, and complete information when placing an order, including your name, email address, shipping address, and payment information. You are solely responsible for any consequences resulting from inaccurate or incomplete information you provide.
1.3 You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
2. PRODUCTS
2.1 We make every reasonable effort to display our products accurately. However, colors, sizes, and appearance may vary slightly due to screen settings, lighting, and manufacturing variations. Minor variations do not constitute a defect.
2.2 Product images, including lifestyle and promotional images, are for illustrative purposes only. Accessories, props, or items shown in images are not included unless expressly stated in the product description.
2.3 We reserve the right to modify product descriptions, discontinue any product, or limit quantities at any time without notice.
3. PRODUCT USE AND SAFETY
3.1 You agree to use all products solely for their intended purpose and in accordance with any instructions, warnings, and weight or age limits provided with the product or on the product page.
3.2 Products intended for infant care, including changing stations, bassinets, and play accessories, require continuous adult supervision. NEVER LEAVE A CHILD UNATTENDED while using any of our products. Products must be placed on a stable, flat surface when in use.
3.3 You are responsible for inspecting each product before every use and discontinuing use if any part is damaged, worn, loose, or missing.
3.4 To the fullest extent permitted by law, Baby Pack shall not be liable for any injury, damage, or loss resulting from misuse, modification, improper assembly, lack of supervision, or use of a product contrary to its instructions or intended purpose.
4. ORDERS
4.1 When you place an order, you make an offer to purchase and authorize us and our payment processors to charge your selected payment method for the full order amount.
4.2 Your order is not accepted until we confirm acceptance. We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear to be placed by resellers, orders suspected of fraud, or orders affected by pricing or product information errors. If we cancel an order after payment has been collected, we will issue a full refund.
4.3 You represent that your purchases are for personal or household use only and not for commercial resale.
5. PRICES AND PAYMENT
5.1 All prices are listed in U.S. Dollars (USD). Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation email.
5.2 Promotional offers, bundles, and discounts are valid only for the period stated and cannot be applied retroactively to previous orders or combined with other offers unless expressly stated.
5.3 You represent that you are authorized to use the payment method you provide and that all payment information is true and complete.
6. FREE GIFTS AND DIGITAL PRODUCTS
6.1 Free gifts and bonus items included with qualifying purchases are offered while supplies last, have no cash value, and may be substituted with an item of equal or greater value without notice.
6.2 Digital products, including e-books and downloadable guides, are delivered electronically to the email address provided at checkout. You are responsible for providing a valid email address. Digital products are licensed, not sold, for your personal, non-commercial use only. You may not copy, reproduce, resell, share, or distribute any digital product, in whole or in part.
6.3 The content of our digital products is provided for general informational and educational purposes only and does NOT constitute medical, health, or professional advice. It is not a substitute for consultation with a pediatrician, physician, or other qualified healthcare provider. Always seek the advice of a qualified professional regarding your health or your child's health. Never disregard professional advice or delay seeking it because of something you read in our materials. In case of emergency, contact your local emergency services immediately.
7. SHIPPING AND DELIVERY
7.1 We offer free standard shipping on orders delivered within the United States.
7.2 Orders are processed within one (1) to three (3) business days. Estimated delivery time is eight (8) to ten (10) business days after processing. All delivery times are estimates only and are not guaranteed.
7.3 We are not liable for delays caused by shipping carriers, weather, holidays, high demand periods, or other events beyond our reasonable control.
7.4 You are responsible for providing a complete and accurate shipping address. We are not responsible for orders lost, delayed, or misdelivered due to incorrect or incomplete address information provided by you.
7.5 Risk of loss passes to you upon delivery as confirmed by the carrier's tracking information. We are not responsible for packages stolen after delivery confirmation.
8. RETURNS AND REFUNDS
All returns, refunds, cancellations, and exchanges are governed exclusively by our Refund and Return Policy, which forms part of these Terms.
9. CHARGEBACKS AND PAYMENT DISPUTES
9.1 You agree to contact us first at babypackadmin@gmail.com to attempt to resolve any issue with your order before initiating a chargeback or payment dispute with your bank or payment provider.
9.2 If a chargeback or dispute is filed, you authorize us to provide your order details, communications, delivery confirmation, and any other relevant records to the payment processor or financial institution. We reserve the right to refuse future orders from customers who file unfounded or fraudulent chargebacks.
10. INTELLECTUAL PROPERTY
10.1 All content on the Services, including the Baby Pack name, logo, trademarks, text, images, graphics, videos, product descriptions, and digital products, is owned by or licensed to Baby Pack and is protected by applicable intellectual property laws.
10.2 You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content without our prior written consent.
10.3 The purchase of any product does not grant you any intellectual property rights in the product, its design, or related materials.
11. REVIEWS AND FEEDBACK
11.1 If you submit reviews, comments, photos, videos, suggestions, or other content ("Feedback"), you grant Baby Pack a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such Feedback in any medium, including for marketing and promotional purposes, without compensation to you.
11.2 You represent that your Feedback is truthful, that you own or have the right to submit it, and that it does not violate the rights of any third party. We may, but are not obligated to, monitor, edit, or remove any Feedback at our discretion.
12. THIRD-PARTY TOOLS AND LINKS
The Services may include third-party tools, payment processors, apps, or links to third-party websites. We do not control and are not responsible for their content, policies, or practices. Your use of any third-party tools or websites is at your own risk and subject to their terms.
13. RELATIONSHIP WITH SHOPIFY
Baby Pack is powered by Shopify. All sales and purchases you make in our store are made directly with Baby Pack. Shopify is not responsible for any aspect of any sale between you and Baby Pack, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases from Baby Pack.
14. PRIVACY
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and disclose your personal information. Because the Services are hosted by Shopify, Shopify also collects and processes certain information about your use of the Services in accordance with Shopify's Privacy Policy.
15. ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information, or to cancel orders, at any time without prior notice, including after an order has been submitted. If we cancel an order after payment, we will issue a full refund.

You may not use the Services: (a) for any unlawful purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property or that of others; (d) to harass, abuse, defame, or harm any person; (e) to submit false or misleading information; (f) to place fraudulent orders or file fraudulent claims; (g) to upload viruses or malicious code; (h) to use bots, scrapers, or automated tools to access the Services without our consent; or (i) to interfere with or circumvent the security features of the Services. We may suspend or terminate your access at any time, without notice, for any violation of these Terms.

18. DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED BY BABY PACK, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
19. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BABY PACK, ITS OWNERS, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.
IN ANY CASE, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
20. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Baby Pack, Shopify, and their respective affiliates, owners, agents, contractors, and service providers from any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from: (a) your breach of these Terms; (b) your violation of any law or the rights of any third party; (c) your misuse of any product; or (d) your use of the Services.
21. DISPUTE RESOLUTION
Before filing any claim, you agree to first contact us at babypackadmin@gmail.com and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days. Nothing in this section limits any rights you may have to bring claims under mandatory laws that apply in your place of residence.
22. TERMINATION
We may terminate these Terms or your access to the Services at any time, at our sole discretion, without notice. You remain liable for all amounts due up to the date of termination. Sections relating to product use and safety, digital products, intellectual property, feedback, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution survive termination.
23. SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the remainder shall be severed, without affecting the validity of the remaining provisions.
24. WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right. These Terms and our posted policies constitute the entire agreement between you and Baby Pack and supersede any prior agreements, communications, or proposals, whether oral or written.
25. ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice to you.
26. ELECTRONIC COMMUNICATIONS
By placing an order, you consent to receive transactional and service-related communications electronically, including order confirmations, shipping updates, digital product deliveries, and policy notices, at the email address you provide. You are responsible for keeping your contact information current.
27. LANGUAGE
These Terms are written in English. If they are translated into any other language, the English version shall prevail in the event of any conflict.
28. CHANGES TO THESE TERMS
We reserve the right to update, change, or replace any part of these Terms at any time by posting changes to our website. Changes take effect upon posting. Your continued use of the Services after changes are posted constitutes acceptance of those changes. The Terms in effect at the time of your purchase govern that purchase.
